These terms set clear responsibilities for Happily Surveys and organizations using the platform. They work together with our Privacy and Data Protection Notice.

Using the service
Happily Surveys helps authorized organization representatives create, deliver, analyze, and report on employee surveys. You must use the service lawfully, provide accurate account information, protect account credentials, and ensure that people with access to results are authorized.
You may not use the service to discriminate unlawfully, make solely automated employment decisions, collect information you do not have authority to collect, probe another customer’s data, or interfere with the service.

Your organization’s responsibilities
The organization running a survey determines its purpose, questions, recipients, lawful basis, privacy notice, access rules, retention, and response to employee requests. It must avoid unnecessary sensitive data and must not describe a survey as anonymous when its questions, distribution, team sizes, or reporting practices could reasonably identify a person.
The customer owns and controls its survey content and response data. Happily processes hosted survey data to provide the service under the customer’s instructions, subject to the Privacy Notice and any signed Data Processing Agreement.

Customer data and research
We do not sell customer survey data. We do not use identifiable customer survey responses for public benchmarking, model training, or unrelated research.
Any benchmarking or research use requires a separate, documented authorization that explains its purpose, data, safeguards, retention, and withdrawal terms. Buying or declining a paid plan does not determine whether customer data may be used for research.

AI-assisted features
AI features create editable drafts from survey data selected by an authorized user. AI output may be incomplete, inaccurate, or inappropriate. The customer must review it before sharing or using it and must not rely on it as the sole basis for an employment decision.
Customers should avoid sending names or unnecessary sensitive information to AI features and should tell employees how qualitative feedback may be analyzed.

Security and confidentiality
We maintain technical and organizational measures intended to protect hosted customer data. Customers remain responsible for managing workspace members, protecting exports and shared links, and promptly reporting suspected unauthorized access.
No online service can guarantee absolute security or uninterrupted availability. Self-hosting organizations are responsible for the security, backups, updates, monitoring, vendors, and legal compliance of their deployment.

Retention and account closure
Customers may delete surveys and their linked responses through the product. Account deletion currently requires a verified request to privacy@happily.ai. Some limited information may be retained where required for billing, fraud prevention, dispute resolution, security, or other legal obligations.
Customers should export needed data before deletion. Backup copies may remain for a limited recovery period and are not restored except as part of disaster recovery.

Changes and contact
We may update these terms as the product or law changes. We will provide reasonable notice of material changes. The effective version and date will be shown on this page.
